(1) The inquiry committee shall exercise the powers exercised by the commission constituted under the Inquiry Commission Act, 2026 in relation to providing information to the judge of the High Court or District Court, receiving information, taking statements or understanding witness evidence. (2) The proceedings of the inquiry committee under this section shall be confidential.
(3) The inquiry committee shall not allow any person other than the accused High Court or District Court judge, the concerned legal practitioner and the complainant to be present or participate in the proceedings at the place of inquiry. (4) The inquiry committee may punish a person who disobeys the order given by the inquiry committee or obstructs the proceedings of the inquiry with a fine up to three thousand rupees or imprisonment up to one month or both.
(5) The concerned person may ask for pardon before the investigation committee without ordering the punishment according to sub-section (4). If the inquiry committee is satisfied with such an apology, the inquiry committee will not impose any punishment.
(6) If the person punished by the investigation committee in accordance with sub-section (4) apologizes to the satisfaction of the investigation committee, the investigation committee may not execute the punishment.
(7) After the completion of the investigation, the investigation committee shall submit the investigation report along with its opinion and related documents to the Secretariat of the Judicial Council.
